Brexit, Settled Status and Citizenship application. Do you need a Certified Translation?

BREXIT IS AROUND THE CORNER! The UK is scheduled to leave the EU 31st January 2020. The government is ending the priority given to EU migrants over those from other countries. If you’re an EU citizen living in the UK, you and your family will be able to apply to the EU Settlement Scheme to continue living in the UK after 30 June 2021, or 31 December 2020 if Britain leaves the bloc without a deal. The security minister, Brandon Lewis, has recently declared that EU people who do not apply before the residency deadline may be removed from UK. If your application is successful, you’ll get either settled or pre-settled status. You may refer to the Government website for eligibility criteria.

If you are granted settled status, you will be able to stay in the UK indefinitely (provided you don’t spend more than five consecutive years outside the UK). You may apply for British Citizenship, work in the UK, study in the UK, use the NHS, and access public welfare programmes. Family members may join you with a Family Visa.

On the other hand, many British people are applying for citizenship of an EU country. If your grandparents were born in France, or if you have married an Italian citizen, and you wish to secure your right to work and travel around the EU after Brexit, without restrictions, you may apply to become a citizen of their birth country.

Even though the process varies, depending on your application, you will usually require to translate some documents, such as:

✓ Passport / ID Card

✓ Bank statements

✓ Employment letters

✓ Details of any criminal convictions, if applicable

The UK is scheduled to leave the EU at 11pm UK time on Friday, 29 March 2019. A European court has ruled that the UK can decide to stop the process. Alternatively it can be extended if all 28 EU members agree, but at the moment all sides are focusing on that date as being the key one, with or without a deal.

If you’re an EU citizen, you and your family will be able to apply to the EU Settlement Scheme to continue living in the UK after 30 June 2021. Even if you have a Permanent Residence document, you must still apply for settled status. If your application is successful, you’ll get either settled or pre-settled status. You may refer to the Government website for eligibility criteria.

IMPORTANTE: ESAME di LINGUA ITALIANA

A decorrere dal 04/12/2018, è condizione indispensabile per il riconoscimento della cittadinanza per matrimonio, il possesso di un’adeguata conoscenza della lingua italiana non inferiore al livello B1 del Quadro comune di riferimento per la conoscenza delle lingue. L’accertamento di detto requisito va effettuato attraverso l’acquisizione di un titolo di studio rilasciato da un istituto di istruzione pubblico o paritario oppure di una certificazione rilasciata da un ente certificatore.

Sono esentati dall’obbligo di presentazione della certificazione linguistica i cittadini stranieri, già residenti sul territorio italiano, che provino di aver sottoscritto durante la loro permanenza in Italia, l’accordo di integrazione di cui all’art. 4bis del D.lgs nr. 286/98 e al DPR 179/2011.

Tuttavia, per i residenti all’estero, l’eventuale possesso di un permesso di soggiorno italiano non può sostituire il certificato B1. Per legge, il permesso italiano deve anzi ESSERE RESTITUITO ALLA QUESTURA VIA POSTA RACCOMANDATA, una volta che il coniuge sia iscritto all’A.I.R.E. Non si può essere contemporaneamente titolari del permesso di soggiorno italiano e di quello britannico.

Nel Regno Unito, è possibile sostenere gli esami per il rilascio dei certificati di competenza linguistica CLIQ presso diversi enti, indicati nella pagina web dedicata del Portale della Lingua Italiana. Gli enti certificatori CLIQ (Certificazione Lingua Italiana di Qualità) – eventualmente in regime di collaborazione con i locali istituti italiani di cultura – sono esclusivamente l’Università per stranieri di Siena, l’Università per stranieri di Perugia, l’Università Roma Tre e la Società Dante Alighieri.

Tra questi enti, vi segnaliamo La Dante in Cambridge, che organizza regolarmente sessioni d’esame. Per un aggiornamento sulle date disponibili, si prega di controllare regolarmente il loro sito.

Importante: La certificazione comprovante la conoscenza della lingua italiana è uno dei documenti da caricare al momento della domanda di concessione della cittadinanza italiana per matrimonio. Perciò, l’esame va fatto PRIMA di poter presentare domanda. A questo fine, si prega di contattare direttamente gli enti certificatori, o il Consolato, ai fini di qualsiasi chiarimento riguardo gli esami di lingua, e non la nostra agenzia.  Baraka Translations NON è attualmente un centro d’esame, né può emettere il certificato B1 di lingua italiana di cui sopra.

La Brexit ha portato con sé una grande incertezza per cittadini dell’Unione Europea che vivono nel Regno Unito. Dopo 5 anni di continua residenza in UK, un cittadino EEA/EU può fare domanda di Permanent Residence Card (Carta di soggiorno permanente) in UK. Per coloro che siano qui da meno di 5 anni, è possibile fare domanda per il Registration Certificate (Certificato di residenza).
