Changement de prénom et/ou de nom de famille par “deed poll”

Dans le droit anglais, une personne peut changer de prénom et/ou de nom de famille à sa guise. La loi ne s’intéresse que sur la question de savoir si une personne a bien adopté et se fait habituellement connaitre sous un nom autre que celui de naissance. Aussi longtemps que c’est le cas, le changement de nom de famille sera valable.

Aussi longtemps que la démarche ne poursuit pas des fins frauduleuses ou d’autres fins illégales, une personne peut prendre n’importe quel prénom et/ou nom de famille sans aucune formalité et elle peut s’identifier, et être identifiée par le prénom qu’elle a adopté.

La preuve d’un changement de nom (prénom et/ou nom de famille) peut être fournie grâce à une procédure connue sous le nom de « deed poll » (acte légal). En vertu de cette procédure, une personne désireuse de changer son nom établit un acte sous une forme bien déterminée, dans lequel elle déclare renoncer à son ancien nom et adopter son nouveau prénom et/ou nom de famille

Les pouvoirs publics au Royaume-Uni reconnaîtront un changement de prénom ou de nom de famille sur la base de la présentation du deed poll. N’importe quelle personne, résidant au Royaume Uni, pourra ainsi changer son prénom et/ou nom de famille sur les documents anglais (y compris le permis de conduire, la carte bleu, etc.).

Pour les citoyens français, la demande de changement de prénom et/ou de nom suite à une décision étrangère (au Royaume-Uni : le “deed poll”) fait l’objet d’une procédure auprès du Procureur de la République près le Tribunal de Grande Instance de Nantes. Le Procureur vérifiera l’opposabilité de la décision étrangère, autrement dit que celle-ci est conforme aux règles du droit français et peut donc produire ses effets en France.

WRITE 2020 IN FULL!

We’ve now entered the year 2020. When signing and dating important documents, do not use /20 for the year 2020.

This prevents any altering of the date. For example, if you write out the date as 20/03/20 (20th of March 2020), a fraudster could backdate your document to 2019, or whatever date in this century he wishes.

Instead, make sure when you’re dating documents in 2020 that you write the year out in full, to protect yourself against fraud.

Brexit, Settled Status and Citizenship application. Do you need a Certified Translation?

BREXIT IS AROUND THE CORNER! The UK is scheduled to leave the EU 31st January 2020. The government is ending the priority given to EU migrants over those from other countries. If you’re an EU citizen living in the UK, you and your family will be able to apply to the EU Settlement Scheme to continue living in the UK after 30 June 2021, or 31 December 2020 if Britain leaves the bloc without a deal. The security minister, Brandon Lewis, has recently declared that EU people who do not apply before the residency deadline may be removed from UK. If your application is successful, you’ll get either settled or pre-settled status. You may refer to the Government website for eligibility criteria.

If you are granted settled status, you will be able to stay in the UK indefinitely (provided you don’t spend more than five consecutive years outside the UK). You may apply for British Citizenship, work in the UK, study in the UK, use the NHS, and access public welfare programmes. Family members may join you with a Family Visa.

On the other hand, many British people are applying for citizenship of an EU country. If your grandparents were born in France, or if you have married an Italian citizen, and you wish to secure your right to work and travel around the EU after Brexit, without restrictions, you may apply to become a citizen of their birth country.

Even though the process varies, depending on your application, you will usually require to translate some documents, such as:

✓ Details of any criminal convictions, if applicable

How to Get a Name Change After Marriage
